Sponsorship of Spouse or Common-Law Partner: A Path to Reunite Families

The sponsorship of a spouse or common-law partner enables a permanent resident or Canadian citizen to sponsor their partner for permanent resident status in Canada. This program is a key component of Canada’s immigration system, designed to help spouses and common-law partners reunite and build their lives together in Canada.

Applications for spousal sponsorship are prioritized by Immigration, Refugees, and Citizenship Canada (IRCC), with the goal of completing the decision-making process within 12 months. Seeking assistance from an experienced immigration consultant can help expedite the application process and ensure that you can bring your loved one to Canada smoothly and efficiently.

Who Can You Sponsor?

Canada allows permanent residents or Canadian citizens to sponsor the following under the spousal sponsorship program:

  • Spouse: Legally married to the sponsor.
  • Common-Law Partner: The individual is in a committed relationship equivalent to marriage for at least one year. Acceptable reasons for not living together must be justified, such as visa denial, work commitments, or studying abroad.

Canada recognizes same-sex marriages, and individuals in these relationships can apply under any of these categories.

Eligibility Requirements for Sponsors

To sponsor a spouse or common-law partner, you must meet the following requirements:

  • You are a Canadian citizen or permanent resident living in Canada, or you have plans to return to Canada.
  • You must submit an undertaking with your application to provide seamless financial support to your spouse and any dependent children. The undertaking ensures that you will cover your spouse’s basic needs, such as:
    • Food, shelter, and clothing
    • Health care not covered by public health insurance

The undertaking becomes effective the day your spouse or common-law partner becomes a permanent resident and remains valid for three years. During this period, you cannot withdraw or cancel the undertaking.

Financial Criteria for Sponsors

Sponsors receiving disability or Employment Insurance Benefits from the government are still eligible to apply, provided they have sufficient income to support their spouse. There should be no ongoing bankruptcy proceedings against the sponsor.

Types of Sponsorship

The spousal sponsorship program includes two main application categories:

  • Inland Sponsorship: Applies to sponsors and their spouses living together in Canada. The sponsored individual must have temporary resident status as a visitor, student, or worker. Inland sponsorship applications are processed within Canada.
  • Outland Sponsorship: The application is processed in the country where the sponsored spouse or partner resides. Outland sponsorship is also available if the spouse is living with the sponsor in Canada. Unlike inland sponsorship, outland sponsorship allows the applicant to appeal a refusal.

Preparing for Sponsorship

Ensuring that you and your partner meet all eligibility criteria before applying is crucial. Consulting a trusted immigration expert will help you submit a complete application and avoid delays. A thorough application increases the chances of faster processing and a positive outcome.

Steps to Apply for Spousal Sponsorship

The application for spousal sponsorship must include the application for permanent residency for your spouse or common-law partner. Follow these steps:

  1. Download the Application Package: Access the application package from the government website, which includes detailed instructions to help you avoid errors.
  2. Prepare Supporting Documents: Gather proof of your relationship, such as:
    • Marriage certificate or proof of common-law status
    • Joint bank accounts, insurance policies, or employment benefits listing both partners
    • Photos, communication records, or other evidence demonstrating your relationship
  3. Complete the Application: Fill out the forms accurately and thoroughly.
  4. Submit the Application: Send your completed application and supporting documents to the appropriate IRCC office for processing.
